Employer fined for failing to take out cover

Commercial insurance

17th November 2009

A company in Cambridgeshire has been fined for not having the correct insurance in place.

Business owner Dipak Kumar Kantial Solanki of Melbourn Stores in High Street, Melbourn, was charged £1,000 by magistrates after he failed to provide evidence to a local environmental health officer in April 2009 that he had paid for compulsory cover.

In response to the case, the Health and Safety Executive (HSE) has emphasised the importance of having proper protection in place for workers, in particular an Employers' Liability Compulsory Insurance (ELCI) certificate.

According to the organisation, it will not hesitate to take action against firms who fail to do so and all businesses must produce ELCI documentation when asked to by an inspector.

"Failing to have this insurance potentially leaves members of staff doubly vulnerable in the event of an accident or ill health," HSE inspector Andrew Saunders observed.

Insurance for business customers are reminded that ELCI is a legal obligation for all employers and certificates should be displayed where staff can read them.
